Judge orders restoration of DACA, opening immigration program to new applicants
GREAT NEWS!
Friday December 4, 2020, a federal judge ordered to fully restore DACA allowing for new applications to be submitted. This is wonderful news!
On June 18, 2020, the Supreme Court issued a decision about the nearly 3-year debate on the validity of the Deferred Action for Childhood Arrivals (DACA) program and the Trump administration’s efforts to terminate it. In short, the Trump Administration could have removed the program but the reasons they gave were not allowed so DACA in its original state from 2012 stands (new applications and travel permission). Until last Friday, USCIS was not following the Supreme Court’s ruling.
What does this mean?
- If you meet the required criteria you can start applying for DACA for new applications
- If you have DACA, you can apply for travel permission if you meet the criteria.
- We are suggesting if you are interested in applying to schedule a consultation soon to discuss eligibility and prepare to file as soon we receive the guidance from USCIS.
Who can apply?
Individuals who meet the following criteria:
- Are under 31 as of June 15, 2012;
- Must be at least 15 years of age to apply or no age requirement if they have a removal order.
- Have continuously resided in the US from June 15, 2007 to the present;
- Entered the US without inspection (unlawfully) or whose visa expired before June 15, 2012;
- Meet the education requirement
- Do not have a criminal record that will bar them
- Do not pose a threat to public safety
